Peter Pothead decides he wants to be a caregiver to medical marijuana patients. The

day he graduates from high school, he forms a corporation called “Higher than a

Kite, Inc.” and begins growing marijuana plants for medical marijuana patients. His

sister, Puffy, smokes a lot of marijuana for the fun of it and has been growing plants

secretly in her parent’s garage loft since she was nine years old. Peter knows

Puffy, who is now a college drop out, has a green thumb when it comes to weed

growing. He hires her to tend to his plants. All is going well and Peter and Puffy are

rolling in the dough. The bank accounts for “Higher than a Kite, Inc.” has $200,000.

The bank manager is amazed at the company’s success because Peter told him he

makes and sells handcrafted kites. Then, one rainy night, the FBI and Michigan State

Troopers raid the pole barn where the plants are growing.

Answer the following:

A).   Can Peter get out of trouble with the FBI if he was growing the allowable

number of plants as a caregiver under Michigan law?

B).   Will the Michigan State Troopers conclude Peter is in any trouble if he was

growing the allowable number of plants under Michigan law?

C).   Is Puffy safe from prosecution under Michigan law because she was merely

an employee of her brother’s company?

D).   If Peter is charged with money laundering, can he avoid personal liability

because he is operating under a corporation?

Explanation / Answer

A) Yes he can be out of the trouble with the FBI because he said to the manager he earned that whole money by selling kites not by making money out of that growing plants and if he is certified medical users and caregivers and growing a allowable number of plants.

B) Yes Peter can be out of trouble if he growing the allowable number of plants as per the Michigan law and if he is certified medical users and caregivers then only.

C) No as she is collage drop out she is not allowed to grow such plants as she is not a certified medical users and caregivers so she is not allowed to work anywhere related to that.

D) No he can't avoid his personal liability as he is operating under a corporation.
